Terms of Service

By commissioning the artist, you the client (herein referred to as the commissioner) agrees to the terms of service:

The artist reserve the right to decline a commission if he does not want to draw the requested subject matter, or for any reason. If you are not sure about this for a given request please just ask.

The terms governing cancellations and refunds is specified separately by the terms of service of the payment escrow provider used to facilitate the transaction between the commissioner and the artist. In the special case instance, and only in the instance, that an escrow provider is not being used in a transaction, a refund policy will be specified by the artist in an additional publicly available document before payment.

The commissioner agrees that they have the permission of all involved parties for the characters they are using in the commissioned piece.

The prices advertised on the commission sheet are estimates and the actual total cost can vary due to complexity in the requested artwork. The actual price quote will be provided during discussion before the payment.

The commissioner must follow the process and guidelines specified in the content guideline document. The artist will provide a reasonable effort to help guide the commissioner along the process towards the completion of the commission.

Work in progress (WIPs) images may be posted online for public consumption. The commissioner can request that WIPs not be posted outside of communications with the commissioner.

The commissioner can request for the commission to not be posted for public consumption, and only to be provided to the commissioner upon completion. You agree that the artist cannot provide warranties that the commissioned image will always be private. If the commissioned image is posted online due to accident, action of a third party, or any other reason, you indemnify the artist to any loss or inconvenience it may cause.

The commissioner can request to be anonymous when the commissioned piece is posted for public consumption. You agree that the artist cannot provide warranties for the anonymity of the commissioner of the commissioned image. If the identity of the commissioner is revealed due to accident, action of a third party, or any other reason, you indemnify the artist to any loss or inconvenience it may cause.

You also agree that the commissioned piece will have to be posted on third party systems to facilitate the transaction (the payment escrow provider's system, DMs, email servers), and other parties may see the commissioned piece (WIPs and/or completed).

The commissioner may upload the commissioned piece to any web site for public display, or private use.

The commissioner may do editing to the commissioned piece in the form of cropping, filtering, resizing, color adjustment, and/or color reduction to fit copies of the commissioned piece into media containers (icons, banners, etc.). Before the commissioner does more substantial edits, the commissioner should ask permission from the artist.

The commissioner may print out the commissioned piece for personal and private use.

The commissioner agrees to not use the commissioned piece for advertising, promotion, and/or profits related to non fungible tokens (NFTs), cryptocurrencies (blockchain-based or otherwise), and/or any other limited supply decentralized digital tokens promoted directly or indirectly as investment vehicles and/or store of value.

Copyright of all images remain with the artist unless otherwise stated.

The commissioner may not misrepresent the provenance of nor misattribute the commissioned artwork.

THE COMMISSIONED WORK WILL BE PROVIDED “AS IS”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL THE ARTIST BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE COMMISSIONED WORK OR THE USE OR OTHER DEALINGS IN THE COMMISSIONED WORK.
